In move to widen dragnet, Putrajaya tables national security bill

Putrajaya today tabled the National Security Council Bill which looked to have returned discretionary powers provided under the Emergency Ordinance (EO), giving the authorities more power to deal with security issues.
The council will be headed by Prime Minister Datuk Seri Najib Razak as its chairman, with members consisting of Deputy Prime Minister Datuk Seri Ahmad Zahid Hamidi, Chief Secretary Tan Sri Ali Hamsa, Defence Minister Datuk Seri Hishammuddin Hussein and Inspector-General of Police Tan Sri Khalid Abu Bakar.
The council provides the power to declare an area a “security area” if there is deemed to be a threat.

In a security area, designated authorities including the army and the police are allowed to arrest or search any individual deemed a threat without a warrant. The bill was tabled for first reading today.
Putrajaya hopes to pass the bill at the current meeting which ends  on Thursday, December 3.
The quorum for the council to meet is with five members. In the absence of Najib, Zahid will chair the council meetings.
The operations of the council will be headed by a director general appointed by Najib among public officers.
It has the powers to impose curfew and also issue directives to any government entities regarding security issues.
The bill also provided protection to the NSC, the director of operations or any member of the Security Forces or the personnel of other government entities from legal proceedings and suits for any action carried out in good faith in the course of their work.
However, prosecution for an offence can be instituted with the written consent, of the public prosecutor.
The council is inspired by the United Kingdom security council, which was set up to deal with cyber security and other evolving security threats.
BN and Umno members have been demanding for a return of the Internal Security Act (ISA) and the EO since they were abolished.
Putrajaya had since introduced a couple of legislations which allowed for detention without trial, as provided by ISA and EO. – December 1, 2015.

the National Security Council (NSC) to take command of the country’s security forces and impose strict policing of areas deemed to face security risks.
According to the Bill, the NSC’s jurisdiction takes effect once the prime minister designates a location as a “security area” — a status that is valid for six months at a time, subject to renewal by the prime minister.
Once the NSC takes over control of a security area, security forces will have the right to search or arrest without warrant any individual “found committing, alleged to have committed, or reasonably suspected of having committed any offence under written laws in the security area”.
The Bill also seeks to empower security forces to arrest without warrant and take action against those who do not abide by an evacuation order from a security area, and also carry out searches of any vehicle or premise within the security area without a warrant.
For operational purposes, the Bill would provide the NSC’s director-general the power to commandeer any land or building in the security area, and order the demolition of any vacant building that is suspected to be used for reasons “prejudicial to national security”.
