Malaysia's embattled prime minister will soon be equipped with supreme security powers, with the much criticized National Security Council (NSC) Act coming into force Monday. The Act allows Najib Razak to designate any area as a "security area", where he can deploy forces to search vehicles, individuals or premises without a warrant, and also allows investigators to dispense with formal inquests into killings by the armed forces or police in those areas. 

Rights groups said they see the Act as a threat to the country's democracy as it is open to abuse. The chief executive of the Institute for Democracy and Economic Affairs, Wan Saiful Wan Jan, says the Act is extremely vulnerable, enabling easy manipulation by a sitting prime minister to protect his personal powers. "The civil societies and others are concerned that the NSC can be used against anything that the government is unhappy with, including street rallies, which are the voice of the people," he said.

As an example, he says that under the bill – to be chaired by the prime minister – "if a street rally is scheduled to take place demanding Razak's resignation he can declare the venue of the rally as 'a security area', which means people can be arrested and no one can question the actions".

Razak has been under tremendous political pressure, and calls have been made for him to resign over international probes for corruption into a state wealth fund he heads.

The security area would be valid for six months at a time, subject to renewal by the premier, with forces in the area given sweeping powers, including the capability to arrest and search persons, enter and search premises, and seize property without a warrant. Furthermore, forces will be allowed to use force against persons -- including force amounting to death -- as they deem reasonable and necessary in the circumstances "to preserve national security".

Moreover, the Act grants immunity to members of security forces and personnel of other government entities for their acts in any of the security areas. The NSC Act was gazetted under the federal constitution June 7, although the law did not receive the official consent of the Malaysian King and the country's powerful Conference of Rulers. Via the conference, the rulers had highlighted their unhappiness and demanded for the law to be fine-tuned -- a request seemingly ignored by the government. Both the upper and lower houses of Parliament passed a bill to enable the NSC Act on Dec 22 last year, despite heavy protests from opposition lawmakers and civil society groups.

They alleged that the Bill would grant powers to the prime minister detrimental to the position of the Malaysian King and the Federal Constitution. Razakh, however, has said that his administration would never interfere with the powers of the King or the Conference of Rulers. Minister in Prime Minister's Department Shahidan Kassim says that that the Act would not give the prime minister "dictator-like powers".

"The powers given under the Act will not make the prime minister a dictator, as the power to declare a state of emergency still remain with the Malaysian King," he said on Saturday He underlined that Malaysians must be aware of the threat posed by Daesh and other militant groups in the country, and thus such a law is needed to take control of the situation in such cases.

The United Nations Human Rights Office for Southeast Asia has said provisions under the Act run counter to the requirement to investigate wrongdoing. "We are gravely concerned that the immunity provisions in the Act may encourage human rights violations," Laurent Meillan, OHCHR's acting regional representative in Bangkok, said in a statement this week.

She expressed concern that the Act could also be used to impose unjust restrictions on freedom of opinion and expression and freedom of assembly.

"We call on the [Malaysian] government to revise the Act to bring it in line with international human rights norms and standards," she said. "Furthermore, we encourage the government to allow for an open and transparent consultation process on the provisions in the Act with all relevant stakeholders."

Our nation lurches from one crisis to another. It stumbles, falls and then crawls towards another day in the hope that another day may bring about blessed relief from the vagaries and toxic fallout that that our politicians seems bent on inflicting upon us all. Upon you and me. But always, what another day brings upon us is more of the same -  only more delibitating, more punishing and takes from us, bit by bit, that will to stand up to the criminal political elites that are responsible for these deeds!

And why should we not feel helpless and hopeless in the face of this Umno led Barisan Nasional government hell bent upon imposing their political will upon anyone that stands in their way to govern? Why indeed!

Let me speak for myself. 

I have lived through everyone of those 22 years of Mahathir's time as prime minister...every one of them! There are many stories I can tell of what that man did to and for our country, to and for our people and of course to and for himself but I know this to be a fact.... Mahthir is not a corrupt prime minister. 

He erred in many ways. He was petulant to the point of being vengeful when faced with anyone that dares to question his commitment to  make the change he deemed Malaysia and Malaysians needed and he unhesitatingly and some say wickedly, wielded the considerable political clout he had to neutralise and pulverise any dissent. His use, misuse and abuse of political power was done with impunity and he went about consolidating that ability in his personal self because for Mahathir, the ends justifies the means....an obsession that has spawned two prime minister after Mahathir, both of whom, by the things that they do in the name of government, has since shown Mahathir the error of his ways. 

Yes Mahathir erred. Today Malaysia and Malaysians have in Najib Razak  the prime minister that Mahathir's has to take responsibility for spawning.

To his credit, Mahathir has taken that responsibility and is doing something about it....possibly too little and too late. This we will  only know in the fullness of time. To those of you unforgiving of Mahathir's ways during his time as lord and total masters over all things Malaysian may I remind you of this. If, after a life of sins and frivolities, a Muslim with the last breath he draws upon this earth intones "laa ilaaha illallah Muhammad Rasulullah'. ..maka “Tidak masuk neraka orang yang mengatakan laa ilaaha illallah.” ...so who are we mere mortals to not forgive Mahathir for what he has done if he has now repent?...but I digress. 

   

For now our people and our nation have to deal with Najib Razak  and that seems to be an impossibility given that Najib has the political will, the large armies and deep pockets that he needs to stay where we do not want him to stay : as prime minister of Malaysia.

For too long and too often we have been told that Najib is a dead man walking! 

Believe what you want of the things you have heard and read about the imminent political demise of Najib Razak but I can tell you that the man is alive and well, in good health and living the good life with all his faculties intact.  And come 1st August the National Security Act will hand him dictatorial powers to do what he likes, against whoever he likes for any six months at a time. And if you think what Najib has done in the past is abominable...you ain't seen anything yet!

What is the National Security Act?

One clause of that act will tell you what the NSA is all about  and I call it the "Dirty Harry make my day" clause ...."the clause that cancels the formal inquest into the death of anyone killed by army or police in any crackdown under its provisions". 

Translation : The authorities can kill anybody they like by invoking the above act and there is nothing any one can do about it!

We are all familiar with these names : Teoh Beng Hock, Kugan, Aminurasyid, Altantuya, Kevin Morais, Najadi Hussein and many many others...all killed on the streets of Malaysia or while in the custody of the authorities...and we have seen how impossible it has been to bring the perpetrators of these murders to justice. 

After 1st August 2016, the authorities can invoke that "Dirty Harry make my day" clause and close one eye and shut the other when the army or the police, acting on the orders of the BN government, shoot anyone dead!

That "anyone they can shot dead" includes you and me! 

Think about that for a bit today and try to get your head around "."the clause that cancels the formal inquest into the death of anyone killed by army or police in any crackdown under its provisions". Imagine giving that power to Najib Razak!

Ready to riot for Najib

Najib has not hesitated to get his paid-up bullies in Red Shirts onto the streets to threaten ordinary folk, following the DOJ’s devastating details over his thefts from 1MDB.

But it’s next week that he plans to really take charge.

On 1st August his shocking National Security Act comes into force, designed to hand him dictatorial powers wherever he likes, against whom he likes for any six months at a time. 

Then he can renew those powers.

The bill was introduced without warning late on the final day of the Parliamentary session at the end of last year. Surprised MPs were given no time to scrutinise it, let alone put forward amendments and the debate was cursory as it was rushed through its stages in an effective pre-planned coup by the Prime Minister against his Parliament and the democratic rights of his own people.

Even the Sultans and the Agong have been shocked into a rare refusal to sign it unamended – but rather than accept their counsel on a matter of core national security he has brushed their concerns aside and forced it into law unchanged or re-considered.

That Najib’s excuse was the need to combat ISIS is no surprise.  Yet the terms of this Act would lead anyone to conclude that Malaysia has experienced worse threats than Europe, Indonesia and the US put together, which of course is not true.

None of those countries have attempted to create such sweeping powers to combat terrorists – the reason being that this law has nothing to do with fighting criminals… and everything to do with protecting the one who is presently in charge.

Is Najib Razak a safe pair of hands for such powers?

To give just a single example of the evil intent of this National Security Act, consider the clause that cancels the formal inquest into the death of anyone killed by army or police in any crackdown under its provisions.

Someone must have thought closely to insert such a sinister detail in advance.  That someone must have decided that they are tired of being inconvenienced by all the paraphernalia of the law when it comes to murder cases. That person wants to be freed from questioning and investigation, when someone who gets in his way is ordered dead.

Does Malaysia want to place such a dangerous law in the hands of a desperate thief and liar like Najib, who is furthermore himself personally associated with a string of murky, half-solved murders?

And yet, the mainstream press in Malaysia has been almost as silent on this deadly law, as over the shocking revelations by America’s Department of Justice about their Prime Minister’s thefts from 1MDB.  The story which has been headlines for the past two days in every other country in the world has remained virtually unreported where it is most relevant – Malaysia.

Core messages the Malaysian media are avoiding!

What press coverage there has been has even attempted to pretend that the description of Najib as ‘Malaysian Official 1′ means that he has somehow not been identified in the US indictment.  Do they think Malaysian’s are laughably stupid?

For the avoidance of doubt the PM is plainly and clearly identified in the United States Department of Justice indictment as the corrupt official who received $681 million in his private bank account direct from 1MDB (no Saudi Royals in sight).

The rest of the world media has had zero problem in making the connection, as evinced by the headline at the top of this article.  It is merely that legal documents only cite by name those who are directly moved against in that indictment – since Najib placed the US-based loot in the name of his step-son Riza and Jho Low (both now hiding in Malaysia and Taiwan) he was not directly relevant to that indictment.

However, his proven duplicity and shocking level of corruption is supremely relevant to people in Malaysia.

Malaysian media have tried to pretend otherwise

Frogs?

There is an over-used analogy, which explains a dangerous torpor, which could finally lose Malaysians their last vestiges of freedom, promising poverty and misery for their country.

A frog will jump out if you put it into hot water, but if you start from cold and heat it up, it stays and cooks.

After years of incremental abuses and ever-worsening corrupted practice, it seems Malaysians no longer understand a tipping-point or see the moment to act.

Revelations that mobilised Icelanders and even people in Brazil to successfully voice their outrage and to pressure the departure of discredited leaders, seem in danger of falling on deaf ears amongst self-defeatist Malaysians, who have perhaps bubbled in the pot too long?

It seems too many prefer to explain why ‘nothing can be done’, rather than take a risk and do it. This paralysis is worst amongst those with the most responsibility to take action now – those around Najib. Their failure to do the necessary is forcing others – ordinary people – to have to do their job of replacing a leader who has lost the plot.

Here we have one of the remaining countries in the world where sodomy remains a crime and was even used to place a popular opposition leader in jail on cooked-up charges. Yet, the population is being asked to nonetheless bend over and be thus abused.

How will once proud Malaysians be able to look other nations in the face if they let it happen and surrender up their freedoms to a thief, who has been exposed and discredited the world over for buying power with money stolen from the poor?
